Terms of Use

Artur is an online platform for conducting survey research and collecting feedback. These Terms of Use for the Artur online surveying service contain information that users must be aware of when using the Artur service at www.artur.com. The Privacy Policy is also an integral part of these Terms of Use.

In these Terms of Use, the following expressions have the following meanings:

  • Artur, we, our refers to the Artur service, accessible at the domain www.artur.com, including all web pages within this domain, including those accessible via password and username.
  • Provider refers to the company Cohortem d.o.o., Litostrojska c. 44E, Ljubljana, which is the owner and operator of the Artur online surveying service.
  • User refers to an individual who visits the website at the domain www.artur.com to provide their opinion or responses to survey questions.
  • Researcher refers to a user who uses Artur surveying services to create online questionnaires and collect survey responses from users.
  • Services refer to all services provided by Artur, which include:
    • Creation of survey questionnaires,
    • Sending invitations to complete survey questionnaires,
    • Answering survey questions, and
    • Statistical analysis of the obtained responses to survey questions.
    • Creation of social proof (web plugin) based on collected feedback.

These Terms of Use apply to every form of use of the Artur service. By using Artur services, both the User and the Researcher agree to these Terms of Use and accept them in full.

The Terms of Use constitute a legally valid and binding agreement between the Provider, the Researcher, and the User of the Artur service and are effective from the moment they are published on the website www.artur.com. They are issued by the Provider, who may change them at any time without prior notice; new terms become effective upon publication on www.artur.com. The User and Researcher are responsible for staying informed about the current Terms of Use at all times and complying with them.

I. GENERAL PROVISIONS

By visiting the website www.artur.com, you have become a user of the services provided by Artur. You may respond to open published surveys, closed surveys to which you have been invited, or create your own online questionnaire to collect survey data. By using the Artur service, you explicitly confirm that you are familiar with these Terms of Use, that you agree with them, that you are bound by their provisions, and that you accept the Privacy Policy.

Use of Artur Service for Lawful Activities Only

As a User or Researcher on the website www.artur.com, you undertake not to use it for illegal activities or in violation of these Terms of Use. The website may not be used in a way that could damage, disable, overburden, or otherwise harm the information system used by Artur. Furthermore, it is prohibited to disable or hinder the use of the website for other users or to gain unauthorized access to any service on the www.artur.com website.

Researcher Email Addresses (for Registration Purposes)

A Researcher must register at www.artur.com to create and analyze an online survey. A valid, correct, and up-to-date email address is a mandatory element for registration. The Provider undertakes to use the Researcher’s email address exclusively for the purposes of the smooth use of the service and for occasional notifications that may interest the Researcher. The Provider reserves the right to send Researchers a questionnaire regarding satisfaction with Artur services, but no more than three times a year. Researchers may unsubscribe from all notifications at any time.

User Email Addresses

Registration is not required for a User of Artur services. In the event that a User is invited to participate in a survey via email, the Researcher guarantees that they obtained this email address lawfully and possesses all necessary documents to ensure the protection of personal data.

The Researcher undertakes that, when using the Artur service to send invitations to participate in surveys, they will not spread unsolicited content, will always use a valid sender email address, and will not exploit the invitation system for direct marketing or sales purposes. When using Artur services, the Researcher will comply with Slovenian legislation and best practices.

II. SECURITY AND DATA ACCESSIBILITY

Data Security

Communication between Users, Researchers, and the website www.artur.com takes place via the SSL (Secure Socket Layer) standard, which uses encryption to ensure that third parties cannot access the data. Additionally, security-sensitive data in the Artur database is stored in an encrypted format.

Storage and Accessibility of Survey Data

The Artur service permanently stores and archives all Researcher surveys. A Researcher may delete their surveys or their Artur user account at any time. Surveys and survey responses remain stored even after they are no longer active and data is no longer being collected. Only Researchers have the right to use the collected survey data for their own surveys. Data is stored on servers that comply with the highest security standards.

For the reliable operation of Artur services, data regarding website usage, process execution errors, and other access log files are recorded, containing the time, IP address, browser type, target file on the server, and the success or failure of requests. These files do not allow for the identification of the User or their survey responses.

The Provider has the right to access, view, and analyze the collected data.

Website Usage Analysis and Cookies

Cookies are necessary for the smooth operation of Artur services and for gaining insights into the needs of Users and Researchers, which help improve the quality of Artur services and the user experience. Data is collected and processed in aggregate form and does not allow for the identification of an individual's specific use of Artur services. We use session cookies, which are deleted at the end of the session, as well as analytical and other cookies that are stored longer. In accordance with the Personal Data Protection Act, every visitor to the portal is informed about the cookies that will be loaded upon their first visit to the website. Every visitor also has the option to reject or delete already loaded cookies in their browser.

III. PRIVACY PROTECTION AND COPYRIGHT

The User and/or Researcher expressly allow the Provider to collect and process data in accordance with the Privacy Policy, which is an integral part of these Terms of Use, for the purpose of providing Artur services.

Occasionally, in accordance with the law, the Provider sends notifications to Researchers' email addresses regarding news, its own services, and products that represent useful and interesting content for recipients. In every message sent, the recipient has the option to unsubscribe from receiving future similar messages.

The collection of personal data in violation of the Personal Data Protection Act is prohibited on the website www.artur.com. We advise Researchers to design survey questions in a way that prevents Users from entering personal data into the database.

Copyright and Intellectual Property

By creating a survey within the Artur service, the Researcher acquires the right to use it; however, only individuals to whom the Researcher grants access have the right to distribute the survey. The Researcher is fully responsible for the content of the survey and, when providing any information or data, particularly survey questions (images, videos, other materials), to the website www.artur.com, guarantees that they have the right to use this information and data or are the owner of the relevant copyrights for the publication of this information and data.

The publication and communication of content that is offensive, falls under the definition of hate speech (Article 297 of the Penal Code), or is otherwise illegal according to current legislation is prohibited. The Researcher is solely responsible for all content published or communicated in any way using the Artur service.

Limited Use of Published Content on www.artur.com

The content of the website www.artur.com and parts of the text, graphics, logo images, buttons, multimedia content, software, and source code are the property of the Provider and are protected by copyright law as intellectual property or as a database.

Imitating the website www.artur.com and performing activities that would harm the reputation, operation, and/or use of the Artur service and/or the Provider is prohibited. Theft or copying of the database, in part or in full, the use of automated queries or other robots that automatically extract data from the website or otherwise automatically interfere or communicate with the website is prohibited, except for search engines or unless expressly agreed with the operator. Prior agreement with the operator is required for any commercial use of the Artur service.

The use of content is permitted provided it is used in the same context and is consistently credited with the source and a link to the website (Author: Artur service; www.artur.com). If these conditions are not met, copying the copyrighted content of these web pages is not permitted under the Copyright and Related Rights Act of the Republic of Slovenia. Violators of copyright and the provisions of the legal notice will be criminally and financially liable for the violations.

IV. RESPONSIBILITIES AND RIGHTS

Responsibilities and Rights of the Provider

Information published on www.artur.com is for informational purposes. The Provider will strive for the accuracy, correctness, up-to-dateness, and usefulness of the website's content but is not responsible for its correctness, accuracy, completeness, or timeliness. When links in online surveys lead outside the www.artur.com domain, these pages are not under the Provider's control, and the Provider has no influence over their content, nor does it guarantee the content and security of these websites or assume responsibility for data protection and security on these websites.

The Provider guarantees that it will attempt to provide Artur services and functionalities at the highest possible level and will strive to rectify operational errors in the shortest possible time. It endeavors to ensure that Artur content and services are available for use every day of the year, 24 hours a day, except for short interruptions due to technical reasons. The Provider reserves the right to terminate the operation of the Artur service at any time, for any reason, and for any period without prior notice if it deems it necessary. The Provider is not responsible for the poor performance or non-performance of the Artur service due to disturbances or non-performance of the internet network or operational disturbances resulting from force majeure.

The Provider reserves the right to change, expand, add, or remove content on www.artur.com and/or the range or modification of Artur service functionalities and/or the user experience at any time and without prior warning. The Provider reserves the right to transfer the management of Artur services to another person.

The Provider undertakes to take all reasonable measures to ensure that data not intended for public display is not accessible to third parties and the public, and that data is adequately protected against unauthorized misuse or loss.

Data collected and processed by the Provider will be disclosed only if such an obligation is determined by law, or in good faith that such action is necessary for proceedings before courts or other state bodies for the protection and realization of legitimate interests.

The Provider is not responsible for any failure or loss of data resulting from misuse, technical inadequacy of software or hardware, or the lack of skill of the User or Researcher. The Provider assumes no responsibility for any direct or indirect damage that the user may incur due to the use of Artur services or the information or content published thereon. This limitation of liability includes, among other things, damage that a user might incur due to the inaccuracy, incompleteness, or incorrectness of published information or the inaccuracy, incompleteness, or untruthfulness of information contained in the content (questions and answers) of online surveys.

Furthermore, the Provider is not responsible for the method of collecting personal data provided to the Artur service by the Researcher for processing and storage.

Responsibilities and Rights of Researchers and Users

Researchers of surveys on the website www.artur.com guarantee they are aware that if they do not have all appropriate permissions for the use and processing of the entered data (especially survey questions) and all appropriate permissions for the processing of personal data, they are liable for offenses and criminal liability in accordance with the provisions of the Personal Data Protection Act and the Penal Code. In the event of a false statement regarding the existence of permissions for the use and processing of the aforementioned data, Researchers assume all legal responsibility and all legal consequences resulting from the non-existence of these permissions. The Researcher confirms that they collected the personal data of Users invited via Artur services to provide responses to survey questions in a lawful manner, in accordance with the applicable legislation in the Republic of Slovenia. By publishing an online survey, the Researcher agrees that its content is publicly published.

Users decide voluntarily to complete online surveys. A User is responsible for the authenticity and seriousness of their responses and ratings. They are also responsible for all consequences arising from violations of regulations or the Terms of Use.

A Researcher may promote higher response rates for their surveys through a prize draw, benefit, or other motivator. In such cases, they are solely responsible for the implementation, notification, payment of taxes, and other obligations arising from this.

Researchers and Users undertake to use Artur services in a manner that does not violate the mandatory regulations of the Republic of Slovenia or these Terms of Use. In particular, they must not publish, send, transmit, upload, or indirectly enable access to content, links to content, or data through which access to content that violates mandatory regulations, current legislation, public order, and morality is possible. This applies especially to content whose storage, possession, or transmission constitutes a criminal offense (e.g., child pornography, human rights violations, etc.), content that violates the personality rights of third parties (including personal data protection and intellectual property rights), or content that encourages national, racial, sexual, linguistic, religious, political, educational, or other discrimination, including discrimination based on financial status, birth, social status, disability, or other personal circumstances.

Any misleading, harmful, controversial, morally inappropriate, or offensive content is prohibited. The use of threats, degrading, or offensive language in communication, as well as language that could violate the personality rights of third parties, or the publication of untrue, illegal, harmful, misleading, controversial, morally inappropriate, or offensive content is prohibited.

The User and Researcher are obliged to act with the diligence of a good businessperson to prevent the spread or distribution of computer viruses, Trojan horses, or other harmful or unsolicited program code via Artur services. A User or Researcher may be held liable for damages and criminal liability for any violation of these Terms of Use.

Intervention in the Survey Process

The Provider is not responsible for the content entered into online surveys by Researchers or Users and assumes no liability arising therefrom. It does not intervene in or review the content published in online surveys by Researchers or Users. However, the Provider reserves the right to check content and to reject, delete, or block the publication of partial or entire content without prior notice if it violates applicable regulations or these general terms. This applies particularly in cases of inappropriate or offensive content, incorrect or untrue publication of personal data, or content that unjustifiably refers to other content or content in other media.

The Provider will do this based on an explicit request from a User, Researcher, or a third party who alerts them that certain survey content is offensive, violates legislation or these terms, or is otherwise inappropriate. Furthermore, the Provider will take appropriate action in the context of a police investigation or court order.

Violations of Terms of Use

Any use of Artur services that could damage, disable, overburden, or harm the Artur service, technical equipment, or the Provider is prohibited. The Provider fully reserves the right to revoke user rights for anyone who violates these rules.

Any User, Researcher, or third party who believes a violation of these Terms of Use has occurred—especially regarding violations of intellectual property rights, personal data protection, Artur service terms, specific advertising terms, or the obligations of Artur service Users or Researchers—is obliged to report this to the Provider at the email address info@artur.com. The process for handling complaints or notifications of violations is confidential. The Provider undertakes to protect the identity of the complainant and data through which the identity could be revealed from access by third parties, unless the user or third party who sent the notification of violation or complaint expressly allows otherwise. The duty to protect data does not apply if the duty of disclosure arises from mandatory regulations.

In the event that any conduct by a User or Researcher shows signs of a criminal offense prosecuted ex officio, the operator of the Artur service will report such conduct to the competent state authorities.

V. FINAL PROVISIONS

All questions, comments, and/or concerns regarding the Terms of Use are accepted at the email address info@artur.com.

The District Court in Ljubljana has jurisdiction over the resolution of all disputes and misunderstandings related to the website www.artur.com that cannot be resolved by mutual agreement.

By clicking the "I Agree" button, the User or Researcher confirms that they have read the content of these Terms of Use and agree with them. Acceptance of these terms is also considered the personal consent of the individual according to the first paragraph of Article 8 of the Personal Data Protection Act.

These Terms of Use are effective as of February 1, 2020.
